1. Terms of Service
By accessing or using Perceptive Vision Transcription Services ("the Service," "we," "us," or "our") at perceptive.vision, you ("the User," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
The Service provides automated speech-to-text transcription with speaker diarization, confidence scoring, cryptographic integrity verification, and encrypted output archiving. The Service is intended for lawful purposes only.
These terms constitute a legally binding agreement between you and Perceptive Vision Transcription Services. Use of the Service constitutes acceptance of these terms in their entirety.
2. Acceptable Use Policy
You may use the Service for any lawful purpose, including but not limited to: transcribing depositions, hearings, meetings, interviews, lectures, podcasts, video content, phone calls (where you have legal authority to record), and other audio or video recordings.
You represent and warrant that:
- You have the legal right to submit any content you upload for transcription.
- You have obtained all required consents from any individuals whose voices appear in the recording, in compliance with all applicable federal, state, and local laws.
- Your use of the Service and the resulting transcription output does not violate any applicable law, regulation, or third-party right.
- You will not present automated transcription output as a sworn, certified, or official record without proper independent human review and verification.
- You will not alter transcription output and represent it as the unmodified original produced by the Service.
3. Prohibited Use
The following uses of the Service are strictly prohibited:
- Submitting content that you do not have the legal right to transcribe.
- Transcribing recordings obtained through illegal wiretapping, unauthorized surveillance, or any method that violates applicable wiretapping, eavesdropping, or recording consent laws.
- Using the Service to fabricate, alter, or misrepresent evidence, communications, or statements.
- Modifying transcription output and representing it as the authentic, unaltered output of the Service.
- Using transcription output to defame, harass, threaten, stalk, or intimidate any person.
- Submitting content that contains child sexual abuse material (CSAM) or content depicting the exploitation of minors.
- Attempting to reverse-engineer, decompile, or disassemble the Service or its underlying technology.
- Using automated scripts, bots, or crawlers to access the Service.
- Attempting to circumvent security measures, rate limits, or access controls.
- Reselling or redistributing the Service without written authorization.
4. Privacy Policy
Information We Collect
The Service is designed to minimize data collection. We do not require user accounts, passwords, or registration. The following information may be collected during normal use:
- Email address (optional) — provided by you at upload for delivery purposes only. Not stored after delivery is complete.
- Payment information — processed entirely by Stripe. We do not receive, store, or have access to your credit card number, CVV, or billing details.
- File metadata — filename, file size, duration, and file type are recorded for processing and included in your deliverables.
- SHA-256 hash — computed in your browser and transmitted with your upload. Stored as part of your archived deliverables.
- IP address and request headers — logged by our web server for security and abuse prevention. Logs are rotated and deleted after 30 days.
Information We Do Not Collect
- We do not use cookies for tracking, advertising, or analytics.
- We do not use third-party analytics services (no Google Analytics, no tracking pixels).
- We do not build user profiles or track you across sessions.
- We do not sell, rent, share, or distribute your personal information to any third party.
Third-Party Services
The Service uses Stripe for payment processing. Stripe's handling of your payment information is governed by Stripe's Privacy Policy. The Service uses Cloudflare for content delivery and DDoS protection. Cloudflare's handling of network traffic is governed by Cloudflare's Privacy Policy.
5. Data Handling & Infrastructure
Perceptive Vision operates on private, air-gapped infrastructure. Our architecture is designed to minimize exposure:
- All file transfers between our servers occur over encrypted private network channels. Processing infrastructure is not directly accessible from the public internet.
- Our web server, routing layer, and processing worker are isolated from each other and communicate only through authenticated private network connections.
- Your source file is transmitted from your browser to our web server, routed to an isolated processing worker for transcription, and the resulting output is returned to the web server for delivery.
- At no point does your source file reside on a publicly accessible server or storage service.
6. Source File Retention & Deletion
Your uploaded source file (audio or video) is permanently deleted from all processing servers immediately upon completion of transcription. We do not retain, archive, back up, or cache your original media file in any form.
Once transcription is complete and your deliverables are generated:
- The source file is securely deleted from the processing worker.
- Any temporary copies created during processing are overwritten and deleted.
- No copy of your source audio or video exists on our infrastructure after processing.
This means we cannot reproduce, replay, or re-transcribe your original recording after processing is complete. If you need a new transcription, you must upload your file again.
7. Output Archive & Retrieval
Unlike your source file, all output deliverables produced by the Service are archived. This protects both you and Perceptive Vision against tampering, misrepresentation, and disputes about what was delivered.
What Is Archived
- The complete transcript with speaker labels, timestamps, and confidence scores.
- The segment data file (JSON) with word-level timing information.
- The PDF document with embedded metadata, hash, and disclaimers.
- The SHA-256 hash verification file.
- A SHA-256 hash of each output file, computed at the time of creation and timestamped.
Archive Duration
All output deliverables are retained in encrypted storage for a minimum of one (1) year from the date of creation. After the retention period expires, archived deliverables are permanently deleted unless a legal hold, dispute, or regulatory obligation requires extended retention.
Retrieval
At the time of delivery, you receive a unique retrieval code. This code is the only method of accessing your encrypted archive. Perceptive Vision cannot access, read, or decrypt your archived deliverables without this code. Lost retrieval codes cannot be recovered, regenerated, or reset. It is your sole responsibility to store your retrieval code securely.
Dispute Verification
Perceptive Vision retains the cryptographic hashes (not the content) of all output files independently of the encrypted archive. In the event of a dispute regarding the authenticity of deliverables, Perceptive Vision may produce these timestamped hashes to verify whether a given file matches the original output. This verification can be performed without decrypting the archive contents.
8. Cryptographic Integrity & SHA-256 Verification
The SHA-256 hash serves as a cryptographic fingerprint of your original file. This hash is:
- Computed entirely in your browser before your file is uploaded, using the Web Crypto API.
- Transmitted alongside your file and embedded in all output deliverables.
- Printed on every page of the PDF document.
- Included in the JSON segment data and hash verification file.
What the Hash Proves
The SHA-256 hash proves that the transcription output was generated from a specific, unaltered source file. If you re-compute the SHA-256 hash of your original file at any later date and it matches the hash printed on your deliverables, this confirms the transcript corresponds to your exact file — byte for byte.
What the Hash Does Not Prove
- The hash does not verify the accuracy of the transcription itself.
- The hash does not authenticate the identity of speakers, the truthfulness of statements, or the context in which the recording was made.
- The hash does not constitute a legal certification, notarization, or sworn attestation.
- The hash does not establish chain of custody prior to upload — it only verifies file integrity from the point of hashing forward.
9. Confidence Scoring & Accuracy Disclaimers
Every sentence in the transcription output carries a confidence percentage generated by our speech processing engine. This score reflects the engine's estimated certainty about the accuracy of the transcribed text.
- 85% and above (High Confidence) — the engine has high certainty in the transcription of this segment.
- 50% to 84% (Low Confidence) — the segment is included but flagged as low confidence. The transcribed text may contain errors.
- Below 50% (Not Legible) — the segment is marked as "not legible." The engine could not produce a reliable transcription. The original audio in this segment may contain background noise, overlapping speech, distortion, or other interference.
All PDF documents and transcripts produced by the Service include a printed disclaimer on every page stating that the output was produced by automated speech processing and is not guaranteed to be 100% accurate.
10. Intellectual Property & Ownership
Your Content
You retain all ownership rights to the source files you upload. Perceptive Vision does not claim any ownership, license, or rights to your source audio or video content. As described in Section 6, your source file is deleted immediately after processing.
Output Deliverables
The output deliverables (transcripts, segment data, PDF documents, hash files, and events timelines) are produced by the Service using Perceptive Vision's proprietary processing infrastructure. Perceptive Vision retains ownership of the output deliverables as work product of its processing engine.
Upon payment, you receive a perpetual, non-exclusive, worldwide license to use, copy, distribute, and modify the output deliverables for any lawful purpose. This license is irrevocable and survives termination of these terms.
Perceptive Vision retains the right to store encrypted copies of output deliverables as described in Section 7, and to produce cryptographic hashes of those deliverables for verification and dispute resolution purposes.
Service Technology
All technology, software, algorithms, interfaces, designs, trademarks, and trade secrets used to provide the Service are and remain the exclusive property of Perceptive Vision Transcription Services. Nothing in these terms grants you any right to the underlying technology, source code, or infrastructure.
11. Payment & Pricing
The Service operates on a per-file, pay-as-you-go basis. There are no subscriptions, recurring charges, or account balances.
- Pricing is calculated based on the duration of audio content detected in your uploaded file.
- The price is displayed before you complete payment. You are not charged until you confirm the transaction.
- All payments are processed securely by Stripe. Perceptive Vision does not receive, store, or have access to your credit card number, CVV, expiration date, or bank account details.
- All sales are final. Refunds are issued at the sole discretion of Perceptive Vision in cases of demonstrable service failure (e.g., processing error that produces no output).
- Refund requests must be submitted within 7 days of the transaction date through the support page.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Perceptive Vision shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of profits, loss of data, loss of business opportunity, or damage to reputation.
- Perceptive Vision shall not be liable for any decisions made, actions taken, or outcomes that result from reliance on transcription output without independent human verification.
- Perceptive Vision shall not be liable for errors, omissions, or inaccuracies in transcription output, including segments marked as high confidence.
- Perceptive Vision shall not be liable for the loss of retrieval codes or inability to access archived deliverables resulting from lost codes.
- Perceptive Vision's total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid for the specific transaction giving rise to the claim.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
Perceptive Vision does not warrant that:
- The Service will be uninterrupted, error-free, or available at all times.
- Transcription output will be accurate, complete, or free of errors.
- Confidence scores will correctly reflect the actual accuracy of any given segment.
- The events timeline will correctly identify or summarize notable moments in your recording.
- The Service will meet your specific requirements or expectations.
14. Indemnification
You agree to indemnify, defend, and hold harmless Perceptive Vision Transcription Services, its owners, operators, affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service or any transcription output.
- Your violation of these Terms of Service.
- Your violation of any applicable law, regulation, or third-party right.
- Content you submit for transcription, including claims that you lacked the legal right to submit such content.
- Your modification, alteration, or misrepresentation of transcription output.
- Any dispute between you and a third party arising from the use or distribution of transcription output.
15. Recording & Consent Laws
Laws regarding the recording of conversations vary significantly by jurisdiction. Some jurisdictions require the consent of all parties to a conversation before it may be lawfully recorded ("all-party consent" or "two-party consent"), while others require only one party's consent ("one-party consent").
By submitting content for transcription, you represent and warrant that:
- The recording was obtained in compliance with all applicable federal, state, local, and international laws governing the recording of conversations and communications.
- All required consents were obtained from all parties to the recording, as required by applicable law.
- You have the legal authority to submit the recording for transcription.
Perceptive Vision does not verify the legality of recordings submitted for transcription and accepts no responsibility for content submitted in violation of recording consent laws. You are solely responsible for ensuring legal compliance.
16. DMCA & Copyright
Perceptive Vision respects the intellectual property rights of others. If you believe that content processed by the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent through the support page.
Your notice must include: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature.
Due to the nature of the Service (source files are deleted immediately after processing), we may be unable to remove or disable access to content that has already been processed and delivered. In such cases, we will cooperate with copyright holders to the extent permitted by law.
17. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
- Arbitration shall take place in the State of Florida, unless the parties mutually agree to an alternative location or virtual proceedings.
- The arbitrator's decision shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.
- Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Perceptive Vision Transcription Services.
Small Claims Exception
Notwithstanding the above, either party may bring an individual claim in small claims court if the claim falls within that court's jurisdictional limits.
18. Force Majeure
Perceptive Vision shall not be liable for any failure or delay in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to: natural disasters, acts of war or terrorism, government actions or orders, epidemics or pandemics, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers (including Stripe and Cloudflare).
In the event of a force majeure, our obligations under these Terms are suspended for the duration of the event. We will make reasonable efforts to resume normal operations as soon as practicable.
19. Termination & Suspension
Since the Service does not require accounts, there is no traditional account termination process. However, Perceptive Vision reserves the right to:
- Refuse to process any uploaded file at its sole discretion.
- Block access to the Service from any IP address or network range suspected of abuse.
- Suspend or discontinue the Service at any time, with or without notice.
- Delete archived deliverables after the minimum retention period has expired.
Sections 10 (Intellectual Property), 12 (Limitation of Liability), 13 (Disclaimer of Warranties), 14 (Indemnification), 17 (Dispute Resolution), and 20 (Governing Law) survive termination of these Terms.
20. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal action not subject to arbitration under Section 17 shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
21. Modifications to Terms
Perceptive Vision reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Since we do not maintain user accounts or email lists, it is your responsibility to review these Terms periodically.
Continued use of the Service after modifications are posted constitutes acceptance of the modified Terms. If you do not agree with any modifications, you must discontinue use of the Service.
